The authors of where we live

THE LATE AUTHOR Gary Poliakoff, was one of the world's foremost authorities on community association law, also author of a nationally published treatise, The Law of Condominium Operations. Ryan Poliakoff is inaugural president of The Ocean Palms, a $100 million condominium property in South Florida.

Gary Poliakoff, who founded Becker & Poliakoff with partner Alan Becker in 1973, died from lung cancer after a two-year battle in August 2014.

Ryan Poliakoff, a lawyer who left the practice of law to become a writer, is the inaugural president of The Ocean Palms, a $100,000,000 condominium property in South Florida. He earned both his B.S. In Communications and a Juris Doctor degree from Cornell University.

Caveats about HOA CC&Rs

Anyone who lives or has lived in a common interest development (aka homeowners association or HOA) has certain cognizance of the covenants, rules, and conditions (CC&Rs) of those "private government" communities.  Virtually every conflict that can and will arise in these locations is the result of CC&Rs that were initially drafted by the community developer and then perhaps altered or amended by the HOA attorneys.  Sometimes those changes need enabling legislation at the state level, but that is a whole different matter.  If the HOA lobby is not 100% behind those changes, the local HOA homeowner has little chance of effecting the change.
